High Court Enforcement
A creditor who succeeds in obtaining judgment in a legal action will want to recover the amount awarded by the court from the judgment debtor. It is not unusual for the debtor to be a little reluctant to pay. High Court enforcement has been shown to be the most effective method of enforcing judgments. For High Court judgments an application is made to the High Court to issue a Writ of Execution (known as a ‘Writ of Fieri Facias’ or’ Writ of Fi Fa’). This is addressed to an Authorised High Court Enforcement Officer and gives him or her authority to collect the money owed under the judgment from the debtor or to seize the debtor’s goods which can then be sold at auction to raise the amount owed.
Using a High Court Enforcement Officer is not limited to those who have obtained a High Court judgment. Someone with a County Court judgment in excess of £600.00 may transfer that judgment to the High Court (a process known as ‘transferring up’). The only exception to this is where the judgment is regulated by the Consumer Credit Act 1974. As part of the service to our clients we can offer the transfer up service free of charge. The only cost is a £60.00 fee which is payable to the court.
